Terms of use

Last updated October 6, 2026

Draft. Highlighted bits are placeholders still to be filled in before launch.

These terms are an agreement between you and [YOUR LEGAL NAME OR COMPANY] ("we", "us") for the Deskercise app, this website and The Desk League. By installing or using Deskercise you agree to them. If you don't, please don't use it.

Health disclaimer

Deskercise is a novelty, not a fitness or medical product. Its calorie figures are estimates from a physical model and published research, and are meant to be fun. They aren't a measurement of your metabolism and aren't suitable for diet, medical, or weight-management decisions.

Nothing in the app or on this site is medical advice. Using a mouse and keyboard is not a substitute for exercise. If you have pain, numbness or tingling in your hands, wrists or arms, take a break and talk to a healthcare professional. Please don't try to "win" by clicking more than is comfortable.

Your license

When you buy Deskercise, you get a personal, non-exclusive, non-transferable license to install and use it on up to [3] computers you own or control, for as long as you like. The purchase is one-time. There's no subscription.

If your purchase includes a spotter key (a second license for a friend), you may give that key to one other person, who then gets the same license under these terms.

If you buy a gift and team pack, each key in it is a separate license for one person: you, or someone you give it to, who then gets the same license under these terms. A pack has the same refund terms as a single license, and refunding it revokes all of its keys.

You may not:

The app, its name, the sweatband-cursor logo and this site belong to us. Buying a license doesn't transfer any of that to you.

Buying and refunds

Purchases are processed by Polar, which acts as the merchant of record and handles payment, tax and receipts under its own terms. Prices are shown at checkout and include or add tax as Polar shows there.

If Deskercise isn't for you, email us within [30] days of buying for a full refund. A refund revokes the license key. This doesn't affect any rights you have under consumer law where you live.

Updates

Updates are included with your license, at no extra cost, for as long as we publish them. We may add, change or remove features. We aren't obliged to keep making updates, and an older version keeps working if we stop.

The Desk League

The League is optional and free for license holders. If you join:

Accuracy

We work to make the numbers sensible, but mouse distance depends on calibration, and calorie estimates are approximations. The app may miss input (for example on Windows' secure screens, on a Mac without Input Monitoring, or while paused) and may contain bugs. Don't rely on Deskercise for anything important, such as timekeeping or billing.

No warranty

Deskercise is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Deskercise. Our total liability for any claim is limited to the amount you paid for your license.

Some places don't allow these limits, so they may not all apply to you. Nothing here limits liability that can't be limited by law.

Ending this agreement

You can stop using Deskercise anytime by uninstalling it. We may revoke a license that's been shared, resold, refunded or charged back, or that breaks these terms. If we do, you must stop using the app. The sections on health, accuracy, warranty and liability survive the end of this agreement.

Changes

We may update these terms. We'll change the date at the top, and for significant changes we'll mention it in the app's release notes. If you keep using Deskercise after a change, you accept the new terms.

Governing law

These terms are governed by the laws of [STATE / COUNTRY], and disputes go to the courts of [COUNTY / CITY, STATE / COUNTRY], unless the consumer law where you live gives you the right to bring a claim locally.
